What can be included in a fatal injury compensation claim?

What can be included as part of any fatal accident claim is complex and depends on a number of factors such as the age of the deceased, their relationship status, whether they had any children and income at the time of death. Our specialist solicitors will guide you through who can make a claim and what for.

By way of general example, if you relied on a loved one’s income you can seek to include loss of future income in any claim. Similarly, if you relied on a loved one for services they provided again loss of those services can be included.

Each claim has to be considered individually though and that’s why it’s important to get the right advice from solicitors experienced in handling such cases.

Who can claim following a fatal accident?

The law recognises that certain classes of people can bring what’s called ‘dependency claim’ arising out of the death of a loved one if the person was dependant on the loved one. Those who can bring a dependency claim include:

  • Spouses (including those who have divorced and had their marriages annulled)
  • Partners who had cohabited for at least 2 years at the time of the incident
  • Civil partners or (formal civil partner)
