Clinical Negligence Investigation – Report Summary
A final report commissioned by Walsall Healthcare NHS Trust has been published (Walsall Healthcare NHS Trust) following the recall of hundreds of patients treated by Orthopaedic Surgeon Mr Mian Munawar Shah. The findings highlight a range of serious concerns regarding the care Mr Shah provided over a number of years, including surgical errors, technical incompetency, and lack of appropriate follow-up.
The Clinical Negligence team at Waldrons Solicitors has been actively assisting a number of former patients of Mr Shah to seek compensation for harm caused by negligent treatment. A formal protocol has been agreed between Waldrons and the Trust’s legal representatives for the management of these claims.
Background of the Case
Mr Shah was employed by the Trust as an Orthopaedic Surgeon from 2004. Concerns began to be raised in early 2020, which led to a widespread patient recall and internal review. Mr Shah was fully suspended by the Trust in 2021. [Express & Star]
A detailed investigation was launched, including an analysis of procedures carried out since 2010. The Trust’s report, published on 11th March 2025, found that:
- 382 patients had undergone procedures of concern.
- 24% of those patients experienced moderate to severe harm due to surgical error. [ITV News]
- The highest harm rate was linked to Latarjet procedures, where 43% of patients were harmed.
- Other high-risk surgeries included shoulder replacements, elbow joint replacements and hand and wrist procedures involving bone fusion and grafting. [Health Service Journal]
The review also criticised the Trust’s lack of appropriate safeguards, which enabled Mr Shah to move into complex upper limb surgeries without the required competency. [BBC News Midlands]
